The city shall limit the number of cannabis retail businesses to no fewer than one registration for every <br />12,500 residents within the City of Elk River, excluding municipal cannabis retail store(s). <br />There is no limit on the number of low potency hemp retailers allowed in the city. <br />There is no limit on the number of medical cannabis combination businesses allowed in the city. <br />DIVISION 4. Requirements <br />Sec. 26-226. Requirements for Cannabis Businesses <br />a) Minimum Buffer Requirements <br />1) The city shall prohibit the operation of a cannabis business within 500 feet of a school as <br />measured from the property line to property line at the nearest point or from property line to <br />the nearest point of the leased premises if the retail business is located in a multi-tenant <br />facility. <br />2) Pursuant to Minn. Stat. 462.357 subd. 1e, nothing in Section 3.1 shall prohibit an active <br />cannabis business or a cannabis business seeking registration from continuing operation at <br />the same site if a (school /attraction within a public park that is regularly used by minors) <br />moves within the minimum buffer zone. <br />b) Hours of Operation <br />1) Cannabis businesses are limited to retail sale of cannabis, cannabis flower, cannabis <br />products, lower-potency hemp edibles, or hemp-derived consumer products to between the <br />hours of 8:00 a.m. and 10:00 p.m. Monday - Saturday, and 11:00 a.m. – 6:00 p.m. on <br />Sunday. <br />DIVISION 5. Temporary Cannabis Events <br />Sec. 26- 227. License Required. <br />A temporary cannabis event permit issued by the city is required prior to holding a temporary cannabis <br />event. <br />Sec. 26-228. Application <br />a) An applicant shall fill out an application form, as provided by the city. The application shall <br />include, but is not limited to: <br />1) Full name of the property owner and the applicant; <br />2) Address, email address and telephone number of the applicant; <br />3) Letter from property owner authorizing the event on their property; <br />4) Site plan of event space, including location and number of access points; <br />5) Proposed capacity of event space; <br />6) Dates of proposed event; <br />7) Duration of event, including beginning and ending times; <br />8) Other information as required by the city based on the type or size of the event. <br />b) The applicant shall include with the application form: <br />Page 88 of 94
