benefits of any kind; fraud or misrepresentation; promissory estoppel; wrongful or constructive <br />discharge; defamation; invasion of privacy; breach of covenant of good faith and fair dealing; <br />reprisal or retaliation; breach of contract; breach of a collective bargaining agreement; unjust <br />enrichment; negligence; negligent hiring; supervision and retention; intentional or negligent <br />infliction of emotional distress; and any other Claim arising under any law. <br />I further agree that if any Claim I release in this Agreement is prosecuted in my name before any <br />court or administrative agency, I will waive any benefits I obtain through such prosecution and <br />will not take any award of money or other damages from such Claim. <br />Notwithstanding the foregoing, this Agreement does not release any rights or claims I may have <br />under the Minnesota Human Rights Act or the Age Discrimination in Employment Act that arise <br />after I sign this Agreement or that arise from acts occurring after I sign this Agreement. <br />Furthennore, this Agreement does not release any post -separation rights I may have under an <br />ERISA welfare benefit or pension plan that are specifically provided for in the applicable plan <br />document or required by law, any rights I may have under any plan subject to Section 409A of <br />the Internal Revenue Code of the United States to the extent the release would cause a violation <br />of Section 409A, or any rights to post -separation benefits continuation under state or federal law. <br />This Agreement also does not prevent me from pursuing any claim to enforce this Agreement, or <br />any right or claim that by law may not be waived. <br />6. Period for Review and Consideration. <br />I acknowledge, agree, represent, and warrant that I have been provided twenty-one (21) days in <br />which to consider whether to sign this Agreement. I understand that I may use as much or as <br />little of this twenty-one (21) day period as I wish prior to signing this Agreement. I also <br />understand that upon the expiration of this twenty-one (21) day period, the offer to enter into this <br />Agreement may be revoked if I have not by then accepted it. I also acknowledge that I have been <br />advised by the City to seek advice of an attorney of my choosing and that I have had the <br />opportunity to obtain such advice before I signed this Agreement. I acknowledge that if I sign <br />this Agreement before the twenty-one (21) calendar days have elapsed, I am voluntarily waiving <br />my right to the twenty-one (21) day review period. <br />7. O :ortunity to Rescind Under the ADEA and MHRA. <br />I recognize that by signing this Agreement I am waiving and releasing any employment <br />discrimination, retaliation, or other claims that he might have under the Age Discrimination in <br />Employment Act ("ADEA"). After I sign this Agreement, I will have seven (7) calendar days to <br />revoke my waiver and release of any claims arising under the ADEA. This right of revocation <br />applies only to claims arising under the ADEA. For a revocation of claims under the ADEA to be <br />effective, it must be personally delivered to Lauren Wipper, City of Elk River, 13065 Orono <br />Parkway, Elk River, Minnesota 55330, or sent by United States certified mail, return receipt <br />requested and postmarked within the 7 day period. <br />I recognize that by signing this Agreement I am waiving and releasing any employment <br />discrimination and retaliation claims that I might have under the Minnesota Human Rights Act <br />("MHRA"). Under the MHRA (Minnesota Statutes § 363A.31), I have the right to rescind this <br />release of claims in writing within fifteen (15) calendar days after signing it.
