ALL CONDITIONS OF THE ORIGINAL ELK RIVER CROSSING PUD, <br />INCLUDING THE DESIGN STANDARDS. <br />2. THE PROPOSED MAXSUN FURNITURE STORE WILL NOT COUNT <br />TOWARD THE BUILD OUT REQUIREMENT STIPULATED IN THE <br />CONTRACT FOR PRIVATE REDEVELOPMENT AND THEREFORE IS <br />INELIGIBLE FOR REIMBURSEMENT TO THE APPLICANT. <br />See Attached Amendment No. 3 to the Elk River Crossing Planned Unit <br />Development Agreement. <br />DATED this 1st day of November, 2004. <br />Page 250 of 304
