y:~6.3a3 <br />x'39633 <br />CHELLE ASHE <br />B ~ DEPUTY <br />O1 JUN 21 P(~ `t 27 <br />J <br />AMENDMENT NO. 1 <br />to <br />ELK RIVER CROSSING <br />PLANNED UNIT DEVELOPMENT AGREEMENT <br />CITY OF ELK RIVER, SHERBURNE COUNTY, MINNESOTA <br />THIS AMENDMENT NO. 1 is made as of the ~~ day of /l'lar ~,t--- , 2001, by <br />and between the CITY OF ELK RIVER, Sherburne County, Minnesota (the City), <br />and Gerald and Angie Koschney, husband and wife. <br />WITNESSETH: <br />WHEREAS, on December 21, 1999, the City of Elk River and Elk River <br />Associated Investors, Inc. hereto entered into the Elk River Crossing Planned Unit <br />Development Agreement; and <br />WHEREAS, Gerald and Angie Koschney purchased Lot 1, Block 1, Elk River <br />Crossing 2nd Addition, and <br />WHEREAS, on February 20, 2001, the Elk River City Council approved an <br />amendment to allow a third wall sign (2 foot by 8 foot illuminated canopy sign) for <br />Wash-n-Fill located on Lot 1, Block 1, Elk River Crossing 2nd Addition. <br />NOW, THEREFORE, it is hereby agreed by and between the parties here as <br />follows: <br />1.) The Elk River Crossing Planned Unit Development Agreement is <br />hereby amended to allow a third wall sign (2 foot by 8 foot illuminated canopy sign) <br />for Wash-n-Fill. <br />2.) The words, phrases, terms, and conditions used herein shall be <br />interpreted the same as those used in the Elk River Crossing Planned Unit <br />Development Agreement. <br />Page 241 of 304
