RESOLUTION 24-65 <br />A RESOLUTION APPROVING THE DISSOLUTION <br />OF THE SHERBURNE COUNTY MUNICIPAL RECYCLING BOARD <br />WHEREAS, the City of Elk River is part of the Sherburne County Municipal Recycling Board <br />(hereinafter referred to as the “Recycling Board”); and, <br />WHEREAS, the Recycling Board is comprised of the Cities of Becker, Big Lake, Elk River, <br />and Zimmerman; and, <br />WHEREAS, the Recycling Board has been in existence since 1999, organized for the <br />purposes of directing and controlling the acquisition and use of shared municipal equipment and <br />tools; and, <br />WHEREAS, the Recycling Board is formed under a Joint Powers Agreement made between <br />the member cities of the Recycling Board pursuant to the authority conferred on the parties to <br />the Agreement under Minnesota Statutes Section 471.59; and, <br />WHEREAS, the Recycling Board, and the activities that it was created to acquire, and use <br />no longer exist, as the member cities can accomplish the purposes of the Recycling Board, if or <br />as required, on their own; and, <br />WHEREAS, the Recycling Board met on October 23, 2024, to consider the city of Becker’s <br />Resolution 24-72, requesting the Recycling Board recommend to the member cities that the <br />Recycling Board and Joint Powers Agreement be dissolved and terminated. <br />NOW THEREFORE, THE CITY OF BECKER HEREBY APPROVES AND AGREES TO THE FOLLOWING: <br />1. The recommendation of the Recycling Board through their Resolution 24-01, that the JPA <br />Agreement and Sherburne County Municipal Recycling Board be terminated and dissolved. <br />2. The disposal of any property owned by the Board and the proceeds be disbursed to the <br />member cities pursuant to the Joint Powers Agreement. <br />Adopted this 18th day of November 2024. <br />_______________________________ <br />John J.
