230498v4 <br />Ordinance 24 - 18 <br />AN ORDINANCE AMENDING CHAPTER 58 - SOLID WASTE, OF THE CITY OF ELK <br />RIVER, MINNESOTA, CITY CODE TO REGULATE YARD WASTE DISPOSAL <br />The City Council of the City of Elk River does hereby ordain as follows: <br />SECTION 1.Section 58-61 of the Elk River, Minnesota, City Code is hereby repealed and <br />replaced in its entirety as follows: <br />Sec. 58-61. – Authorized Collectors. <br />No person shall collect refuse or recyclable materials within the city except the persons holding a <br />contract with the City to do so. No person shall permit refuse to be picked up from their premises <br />except by such a contractor. <br />SECTION 2.That Section 58-39 of the Elk River River, Minnesota City Code is hereby <br />created to read as follows: <br />Sec. 58-39. Compost Transfer Facility regulations. <br />(a)Acceptable materials. The city will only accept yard waste and clean wood less than 6” in <br />diameter at the City’s Compost Transfer Facility. <br />(b)Unacceptable materials. The city will not accept the following items or similar items at <br />the City’s Compost Transfer Facility: <br />•Stumps; <br />•Root balls; <br />•Logs or branches greater than 6” in diameter; <br />•Materials from outside of Sherburne County; <br />•Non-organic materials, including but not limited to, rocks, concrete, or plastics; <br />•Mixed municipal solid waste or solid waste; <br />•Hazardous substances or chemicals; and <br />•Dead animals. <br />(c)Prohibition. No person shall illegally dump at the city’s Compost Transfer Facility. <br />(d)Penalties. <br />Page 50 of 327
