Page 9 of 12 Sec. 2-296. Established. A city planning commission is hereby established. The commission shall be the city planning agency authorized by Minn. Stats. § 462.354, subd. 1(1). Sec. 2-297. Membership. The planning commission shall consist of seven members who are residents of the city. and appointed by the city council for terms of three years. All terms shall end on the last day of February. A vacancy shall be filled by the city council for the remainder of the term. Officers of the commission shall consist of chair and vice-chair, as elected by the commission. The chair shall preside at all meetings of the commission if present, and perform other duties and functions assigned by the commission or the city council. The vice-chair shall perform these duties in the absence of the chair. If a vacancy occurs in the chair office, the vice-chair shall assume the chair'’s duties for the remainder of the year and a new vice-chair shall be elected by the commission at the next scheduled commission meeting. Sec. 2-298. Purpose. The planning commission assists in implementing city plans by making recommendations to the City Council on long-range planning issues, such as land use and transportation, as well as current issues including subdivisions, site plans, conditional use permits, and variances. Sec. 2-2998. Powers and duties. The planning commission shall have and exercise the powers and duties conferred upon such commissions by Minn. Stats. §§ 462.351—462.364 and by ordinances, rules, and regulations of the city. The commission shall also exercise the duties conferred upon it by this Code and by the council. After the commission has prepared and adopted a comprehensive plan, the commission shall periodically review the comprehensive plan, any ordinances, and any capital improvement program the council has adopted to implement the plan. After such review, it shall, to the extent it deems necessary, revise the comprehensive plan, adopt the amendments or the new ccomprehensive plan, and recommend it to the council in accordance with lawthe law. Similarly, after such review, it shall recommend to the council any amendments it deems desirable to the capital improvement program and any ordinance implementing the plan. Sec. 2-300299. Meetings and rules of procedure. The planning commission shall meet regularly on the fourth Tuesday of each month to take action on its official business, including planning-related itemsat such time and place as established per their bylaws. Special meetings may be held at any time upon the call of the chair. Notice of the time and place of a special meeting shall be communicated to the members and publicly noticed at least three days prior to the meeting except in the event of an emergency. A majority of the commission members shall constitute a quorum. All commission meetings shall be open to the public. Except as provided in this article, the commission shall be governed by and operate pursuant to Robert's Rules of Order, Newly Revised (ninth edition). Sec. 2-301. Reports. The planning commission’s reports, conclusions and recommendations shall be made to the city council as may be required. Its reports, conclusions and recommendations are purely advisory, and the final determination and responsibility shall be with the city council. Secs. 2-3020—2-325. Reserved. Page 62 of 464
