<br />City Council Minutes <br />January 17, 2006 <br /> <br />Page 9 <br /> <br />. <br /> <br />Councilmember Motin stated it wouldn't because there would be a condition in the <br />conditional use permit stating the sign will only be allowed on an interim basis. <br /> <br />Spencer Schramm, representing the applicant-Stated the applicant is agreeable to the new <br />conditions but would like the timeframe to be extended to 3-5 years before the city could <br />give notice for removing the sign. <br /> <br />Mr. Beck stated the Council should first deny the variance and then allow the sign as a <br />condition under the conditional use permit. <br /> <br />MOVED BY COUNCILMEMBER FARBER AND SECONDED BY <br />COUNCILMEMBER MOTIN TO DENY VARIANCE, CASE NO. V 05-05 <br />REGARDING AN APPEAL TO A FREESTANDING SIGN. MOTION CARRIED <br />5-0. <br /> <br />Mr. Beck redrafted language to Condition # 2 and #6 of the conditional use permit in order <br />to extend the time period to three years for the applicant to be allowed to keep his sign. <br /> <br />MOVED BY COUNCILMEMBER GUMPHREY AND SECONDED BY <br />COUNCILMEMBER FARBER TO APPROVE A CONDITIONAL USE PERMIT, <br />CASE NO. CU 05-28 TO HASSAN 101, LLC WITH THE FOLLOWING <br />CONDITIONS: <br /> <br /> 1. INTERNAL PARKING AND DRIVE AISLES SHALL BE PAVED. THE <br />. CONCRETE APRON LOCATED ALONG 4TH STREET SHALL BE <br /> REMOVED. <br /> 2. THE DRIVEWAYS ONTO RAILROAD DRIVE MAY REMAIN OPEN <br /> ON AN INTERIM BASIS. IT IS CONTEMPLATED THAT THE <br /> INTERSECTION OF RAILROAD DRIVE AND JACKSON AVENUE <br /> MAY BE CLOSED AT SOME POINT IN THE FUTURE EITHER FOR <br /> SAFETY REASONS OR TO FACILITATE REDEVELOPMENT OF THE <br /> AREA. THEREFORE, THE CITY RESERVES THE RIGHT TO <br /> REQUIRE THAT THE TWO DRIVEWAYS ONTO RAILROAD DRIVE <br /> BE CLOSED AND ACCESS TO THE SITE REORIENTED TO 4TH <br /> STREET AT ANYTIME AFTER DECEMBER 31, 2009, UPON 12 <br /> MONTHS WRITTEN NOTICE FROM THE CITY. <br /> 3. THE EXTERIOR OF THE EXISTING BUILDINGS SHALL BE <br /> PAINTED TO IMPROVE THEIR APPEARANCE. THE EXISTING <br /> FENCES SHALL BE REPAIRED OR REPLACED WHERE NEEDED. <br /> 4. THE LANDSCAPING PLAN SHALL CONCENTRATE THE <br /> LANDSCAPING ALONG 4TH STREET. THE APPLICANT SHALL BE <br /> RESPONSIBLE FOR MAINTAINING THE LANDSCAPING. <br /> 5. A 6' HIGH STOCKADE FENCE SHALL BE CONSTRUCTED ALONG <br /> 4TH STREET. <br />. 6. THE OFF-PREMISE SIGN ON OUTLOT A SHALL BE ALLOWED ON <br /> AN INTERIM BASIS. IT IS CONTEMPLATED THAT <br />
