e ORDINANCE 90 - A2 AN ORDINANCE AMENDING THE CODE OF ORDINANCES ~OR THE CITY OF ELK RIVER SECTION 900.38 AND 1008.04 RELATING TO THE SUBDIVISION OF LAND The City Council of the City of Elk River does ordain as follows: The Code of Ordinances for the City of Elk River, Section 900.38 is amended to delete: d. No building permit shall be issued for the development of commercial, industrial or multiple family structures of four (4) dwelling units or greater for property that is not platted in accordance with the requirements of Chapter X of the City Code. The Code of ordinances for the City of Elk River, Section 1008.04 is amended to read as follows: e 1008.04 - Scope and Legal Authority. The rules and regulations governing plats and subdivisions of land contained herein shall apply within the boundaries of the City of Elk River (the City) in accordance with and as permitted by Minnesota Statutes (the Law). Except in the case of resubdivision, this Ordinance shall not apply to any lot or lots forming a part of a subdivision recorded in the office of the Register of Deeds prior to the effective date of this Ordinance, nor is it intended by this Ordinance to repeal, annual or in any way impair or interfere with existing provisions of other laws or ordinances except those specifically repealed by, or in conflict with, this Ordinance, or with restrictive covenants running with the land. Where this Ordinance imposes a greater restriction upon the land than is imposed or required by such existing provisions of this Ordinance shall control.
