<br />\\G\l~Y) <br />Yoy 1-\e <br />\ '). \ Yb\O'-S <br />r c ~Oj~ <br /> <br />December 8, 2005 <br /> <br />Mr. Scott Harlicker <br />Senior Planner <br />City of Elk River <br />13065 Orono Parkway <br />Elk River, MN 55330 <br /> <br />Dear Scott: <br /> <br /> <br />Thank you for sending a copy ofthe Staff Report, dated 12/13/05, and received via email <br />on 12/5/05, for the Conditional Use Permit for the property at 728 Railroad Drive. <br /> <br />I wanted to provide you with our comments to recommendations outlined on page 3 of <br />the report. <br /> <br />Item # 1. <br /> <br />Item #2. <br /> <br />Item #3. <br /> <br />Item #4. <br /> <br />We will agree to paving the internal farking and drive aisles as well as <br />removing the concrete ramp along 4 t Street. <br /> <br />We respectfully disagree with this recommendation. We would not agree <br />to the closing of the entrance driveways along Railroad Drive. The <br />circulation of our customer pick up and drop off has been designed around <br />the entrance on Railroad Drive and the exit on 4th Street as we have <br />submitted in our site plan. An entrance off of 4th Street would force our <br />customers to enter through our storage yard. <br /> <br />We will agree to the painting of the existing buildings to improve their <br />appearance. This painting shall be limited to the front of the building on <br />Railroad Drive and the side of the building fronting King A venue, as well <br />as the end ofthat building along 4th Street. We also agree to repair or <br />replace the fencing where needed. <br /> <br />We agree to revise the landscaping plan as requested. Unfortunately, we <br />were not able to have the site plan revised by today. Specifically, we agree <br />to add 6 ornamental trees along King Avenue, 6 oversized and 1 regular <br />sized overstory trees, ;md 6 evergreen trees along 4th Street. We would <br />like to have the specific caliper inches of the trees in your <br />recommendation defined and agreed upon prior to planting. We would <br />also ask that any replacement provisions in the City's code be waived <br />with respect to the ongoing survivability of the planted trees. The property <br />does not have water/irrigation service to the City's right-of-way areas and <br />this creates an undue hardship for us. <br />
