<br /> <br />City Council Minutes <br />June 17, 2024 <br />--------- <br />Page 5 of 8 <br />may order the manure and other waste materials to be removed on a more <br />frequent schedule. <br /> Motion Carried 5-0. <br /> <br /> 7.3 Conditional Use Permit: Motor Vehicle Specialty Service Station (Retail Tire Service Station), <br />17994 Zane Street - Les Schwab Tire Center <br /> The staff report was presented. <br /> <br />Mayor Dietz opened the public hearing. <br /> <br />Ron Isaacson, 411 East Main St. Bozeman MT, on behalf of Les Schwab Tire Centers, the <br />applicant stated he is available for questions. <br /> <br />Mayor Dietz closed the public hearing. <br />Moved by Councilmember Westgaard and seconded by Councilmember Grupa to <br />approve the Conditional Use Permit with the following conditions to satisfy the standards <br />outlined in Section 30-654: <br />▪ The parking lot/driveway setback variance (V 24-04) must be recorded before <br />issuing building permits. <br />▪ The use of hazardous materials such as oils, lubricants, chemicals, and solvents shall <br />be handled in accordance with all state standards. <br />▪ The applicant must receive written approval from the existing overhead power-line <br />utility before issuance of building permits. <br />Motion Carried 5-0. <br /> <br /> 7.4 Interim Use Permit: Residential Occupation with Outdoor Storage, 10208 209th Ave NW - Jason <br />Bye <br /> The staff report was presented. <br /> <br />Mayor Dietz opened the public hearing. <br /> <br />Jason Bye, 10208 209th Ave NW, applicant and homeowner. Mr. Bye explained what his company, <br />Tower Electrical and Construction (TEC), does and what he is asking for with the IUP. He explained <br />they are a small wireless construction company that builds and maintains cellphone tower sites with the <br />work done off-site. He also stated if he has deliveries that require a semi, he would make other <br />arrangements, and he plans on following the 18 conditions listed. He continued to say he is asking for <br />similar uses of six other businesses with outdoor storage that are operating within a mile of his <br />location. He has stated he has taken all the appropriate steps that the city has guided him to take and <br />has been openly communicating. <br /> <br />Bryan Rucks, 10296 209th Ave NW, property to the west. He has concerns about the property <br />and is concerned that this property will turn into a property like a salvage yard. He has concerns <br />regarding the neighbor's well and stated it only takes one spill and the first well that will be affected is <br />the neighbor's well to the east.
