Memorandum of Understanding <br />This Memorandum of Understanding entered into this 4`' day of March 2024 is between the City of <br />Elk River and the Law Enforcement Labor Service, Inc. Local #231 (City of Elk River Patrol <br />Officers) <br />Effective December 2023, Article XYII — INURY ON DUTY PAY of the Labor Agreement in <br />force until December 31, 2025, is amended to add the following provision: <br />ARTICLE XVIL INJURY ON DUTY <br />Employees injured during the performance of their duties for the Employer shall be paid the <br />difference between the Employee's regular pay and worker's compensation insurance payments for a <br />period not to exceed forty-five (45) working days per injury, not charged to the employee's vacation, <br />sick leave or other accumulated leave time, for full shifts off work due to injury, in addition to any <br />partial shifts off of work on the initial day of injury, and after four (4) working days initial waiting <br />period per injury. The four (4) working day waiting period shall be charged to the Employee's sick <br />leave account less worker's compensation insurance payments. <br />A qualing employee unable to return to work, cer f ed so by a quaked physician, and injured as a result while <br />actively policing or participating in approved training may request an extension of Injury On Duty Pay up to an <br />additional forty-five (45) working days at the discretion of the city administrator or hisl her designee. The employee <br />may appeal, in writing a denied request to the Elk Diver City Council whose decision is final and ungrieveable. <br />An approved extension will begin after an additional three (3) working days waiting period commencing after the <br />original Injury on Duty period.
