them. Contractor understands licensed Professional Engineer (PE) engineering needs will be limited for this <br />engagement. Utility and its consultants shall be entitled to rely upon the adequacy, accuracy and <br />completeness of the services, certifications or approvals performed by such licensed professionals. <br />1.7Compliance with the LaW. This contract is governed by the laws of the state of Minnesota. The venue <br />and jurisdiction for any court action regarding this contract shall be in Sherburne County, MN. The <br />Contractor shall perform all obligations under this contract in strict compliance with all federal, state, <br />municipal laws, rules, statutes, ordinances, and regulations, especially sections of the Occupational Safety <br />and Health protection for workers, applicable to the performance of the Contractor under this contract. <br />1.8Reimbursement ofExpenses The Utility shall not be liable to the Contractor for any expenses paid <br />or incurred by Contractor unless otherwise agreed in writing. <br />1.9 Employees of Contractor. The Contractor shall be solely responsible for paying its employees. The <br />Contractor shall be solely responsible for the paying of any and all taxes, FICA, workers' compensation, <br />unemployment compensation, medical insurance, life insurance, paid vacations, paid holidays, pension, <br />profit sharing, and other benefits for the Contractor and its employees, servants, and agents. Contractor <br />understands that Contractor is responsible to pay, according to law, Contractor's income tax. <br />1.10 Utility is not responsible for Workers" Compensation: N o workers' com p e n sati o n i n s u ra n ce <br />shall be obtained by Utility concerning Contractor or employees of Contractor. <br />1.11 /nsurance.-ALLEGIANT UTILITY SERVICES, LLC shall provide and maintain the minimum insurance <br />coverage listed below. Coverage will be provided with forms and insurers acceptable to Utility, until all <br />obligations under this Agreement are satisfied. <br />1. Workers' Compensation insurance to cover obligations imposed by Federal and State statutes <br />having jurisdiction of its employees engaged in the performance of the Work, and Employers' <br />Liability insurance with limits of not less than ONE MILLION DOLLARS ($1,000,000). <br />Comprehensive General Liability insurance with a minimum combined single limit of not less <br />than ONE MILLION DOLLARS ($1,000,000) per occurrence and a general aggregate of not less <br />than TWO MILLION DOLLARS ($2,000,000). The policy shall include coverage for bodily injury, <br />broad form property damage (including completed operations), personal injury (with <br />coverage for contractual and employee claims), blanket contractual liability (including <br />coverage for liabilities assumed under this Agreement), and products and completed <br />operations. <br />133 <br />
