CU 05-23 <br />BASED ON THE FOLLOWING FINDING: <br /> <br /> <br />1.THAT IT COMPLIES WITH THE STANDARDS FOUND IN SECTION <br />30-654. <br /> <br />MOTION CARRIED 5-0. <br /> <br />7.9. Request by William Matthews for Conditional Use Permit to Allow Auto Sales, Public <br />Hearing-Case No. CU 05-24 <br /> <br /> Mr. Leeseberg stated the applicant is requesting a conditional use permit to operate an auto <br />sales business from the retail strip mall located at 13479 Business Center Drive. He stated <br />no more than six vehicles would be allowed onsite. Mr. Leeseberg discussed employees, <br />hours of operation, parking, the standards for issuance of a conditional use permit, and <br />Planning Commission action. <br /> <br /> Mayor Klinzing opened the public hearing. <br /> <br />William Matthews, applicant-Stated he was available for any questions. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br /> Mayor Klinzing stated she does not like this type of use in the strip mall. She is concerned <br />about the outside storage of vehicles in the parking lot and how this use may affect <br />surrounding property owners. She questioned if the applicant was going to keep this same <br />business at his other site in Martin Plaza. <br /> <br /> Mr. Matthews stated his existing location does not meet new state requirements for office <br />space so he is moving his business. <br /> <br /> Councilmember Dietz stated he felt the use was not appropriate for the site. He stated it will <br />be confusing to citizens to see the “for sale” signs on parked vehicles. <br /> <br /> MOVED BY COUNCILMEMBER GUMPHREY AND SECONDED BY <br />COUNCILMEMBER DIETZ TO DENY CONDITIONAL USE PERMIT, CASE <br />NO. CU 05-24 BASED ON THE FINDING THAT THE REQUEST CANNOT <br />MEET CONDITION 1, 3, AND 7 OF THE CITY CODE REQUIREMENTS FOR <br />ISSUANCE OF A CONDITIONAL USE PERMIT: <br /> <br />1. WILL NOT ENDANGER, INJURE, OR DETRIMENTALLY AFFECT <br />THE USE AND ENJOYMENT OF OTHER PROPERTY IN THE <br />IMMEDIATE VICINITY OR THE PUBLIC HEALTH, SAFETY, <br />MORALS, COMFORT, CONVENIENCE OR GENERAL WELFARE OF <br />THE NEIGHBORHOOD OR THE CITY. <br /> <br />3. WILL NOT IMPEDE THE NORMAL AND ORDERLY <br />DEVELOPMENT AND IMPROVEMENT OF SURROUNDING <br />VACANT PROPERTY. <br /> <br /> <br />
