Planning Commission Minutes <br />December 19, 2023 <br />Acting Chair Johnson opened the public hearing. <br />Page 3 <br />There being no one present to speak on this item, Acting Chair Johnson closed the public hearing. <br />Moved by Commissioner Keisling and seconded by Commissioner Mauren to recommend approval <br />of the request by the City of Elk River for an Ordinance Amendment regulating Cannabis Growing, <br />Processing, and Manufacturing as outlined in the handout. <br />Motion carried 5-0. <br />5.3 City of Elk River <br />■ Ordinance Amending Section 30-1564 PUD Planned Unit Development District, transitioning from <br />a Conditional Use Permit review to an Ordinance Amendment process, Case No. OA 23-06 <br />Mr. Carlton presented the staff report. <br />Acting Chair Johnson opened the public hearing. <br />There being no one present to speak on this item, Acting Chair Johnson closed the public hearing. <br />Moved by Commissioner Rydberg and seconded by Commissioner Booth to recommend approval <br />of the request by the City of Elk River for an Ordinance Amendment changing the review process <br />for Planned Unit Developments (PUDs) from a Conditional Use Permit to an Ordinance <br />Amendment. <br />Motion carried 5-0. <br />6.1 McDonald's — 700 Dodge Ave. NW <br />■ Conditional Use Permit to amend the Planned Unit Development Agreement to raise the <br />permitted sign height to 61' with electronic messaging, Case No. CU 23-22 <br />Mr. Carlton presented the staff report. <br />Acting Chair Johnson stated he supported adding to the currently allowed 30 feet, an additional 5 feet to <br />allow for the highway barricade height which would raise the permitted sign height to 35 feet above the <br />mainline. He stated this sets a prescience for all the other businesses along Highway 169 and felt in fairness, <br />to be fair for those who were impacted, allowing 5 feet above the median that was constructed. <br />Commissioner Rydberg disagreed with Acting Chair Johnson and discussed the addition of 5 feet for the <br />highway barricade. He requested to see what that would look like but indicated he would allow the <br />applicant's representatives to speak to that. <br />Acting Chair Johnson stated the public hearing was closed. <br />Commissioner Mauren agreed with Acting Chair Johnson with the additional 5 feet and relating it to the <br />street that was in front of the building, relative to the street that is changed.
