Eliminates the quagmire of approval of future amendments of a PUD for specific parcels.
Currently, the conservative approach to amendment of a PUD Agreement for even a single
parcel, would require approval of all parties under the original PUD Agreement and
consents by all mortgage holders, even if the other properties have no direct interest in the
PUD terms for the individual parcel.
Attached are sample ordinances for a PUD zoning process that would change how the City
processes PUDs and documents them in the future and a sample ordinance rezoning specific
property to PUD. PUDs approved prior to such a proposed ordinance would continue under their
existing planned unit development agreements until such time as they are rezoned by request of
the owner or by the city council on its own initiative.
ATTACHMENT
Lakeville Planned Unit Development District, City Code, Title 11, Chapter 96
Elko New Market Planned Unit Development District, City Code Title 11, Chapter 28C
Elko New Market Ordinance No. 176
2
22o1sv2
