CITY OF ELK RIVER <br />SHERBURNE COUNTY <br />CONDITIONAL USE PERMIT <br />Case No. CU 23-22 <br />Permit. Subject to the terms and conditions set forth herein, the Cin- of E1k River hereby grants a <br />Conditional Use Permit ("Permit") requested by SML Electrical on behalf of McDonald's for the following <br />use: <br />Conditional Use Permit to Amend the Planned Unit Development Agreement to Raise the Permitted <br />Sign Height to 35 feet at 700 Dodge Avenue NW <br />Property. The Permit is for the following described property ("Subject Property") in the City of Ell� River, <br />Sherburne County, Minnesota: <br />Lots 5 and 6, Block 6, Barrington Place, Sherburne County, Minnesota, together with an easement <br />for surface draining and storm water run-off over, upon and across the following described property: <br />Oudot A, Barrington Place and all that part of Lot 4, Block 6, Barrington Place, described as follows: <br />Beginning at the Northeast corner of said Outlot A; thence North along the Northerly extension of <br />the East line of said Oudot A, to intersect the Northerly line of said Lot 4; thence Westerly along said <br />Northerly line of Lot 4 to intersect a line 30 feet West of as measured at right angles, to said <br />Northerly extension of the East line of Outlot A; thence South along said parallel line to intersect the <br />Northerly line of said Outlot to the point of beginning, according to the plat thereof on file or of <br />record in the of�ce of the County Recorder, Sherburne County, Minnesota. <br />Owner. Owner of the Subject Property at time of the approval of the Permit: <br />McDonald's Real Estate Company, a Delaware corporation, owner <br />Conditions. None <br />Termination of Permit. The Permit shall remain in effect only for so long as the conditions set for the <br />herein are complied with. The City may revoke the Permit following a public hearing for violation of the <br />terms and/or conditions set forth in the Permit. <br />
