CITY OF ELK RIVER SHERBURNE COUNTY CONDITIONAL USE PERMIT Case No. CU 23-22 Permit. Subject to the terms and conditions set forth herein, the Cin- of E1k River hereby grants a Conditional Use Permit ("Permit") requested by SML Electrical on behalf of McDonald's for the following use: Conditional Use Permit to Amend the Planned Unit Development Agreement to Raise the Permitted Sign Height to 35 feet at 700 Dodge Avenue NW Property. The Permit is for the following described property ("Subject Property") in the City of Ell� River, Sherburne County, Minnesota: Lots 5 and 6, Block 6, Barrington Place, Sherburne County, Minnesota, together with an easement for surface draining and storm water run-off over, upon and across the following described property: Oudot A, Barrington Place and all that part of Lot 4, Block 6, Barrington Place, described as follows: Beginning at the Northeast corner of said Outlot A; thence North along the Northerly extension of the East line of said Oudot A, to intersect the Northerly line of said Lot 4; thence Westerly along said Northerly line of Lot 4 to intersect a line 30 feet West of as measured at right angles, to said Northerly extension of the East line of Outlot A; thence South along said parallel line to intersect the Northerly line of said Outlot to the point of beginning, according to the plat thereof on file or of record in the of�ce of the County Recorder, Sherburne County, Minnesota. Owner. Owner of the Subject Property at time of the approval of the Permit: McDonald's Real Estate Company, a Delaware corporation, owner Conditions. None Termination of Permit. The Permit shall remain in effect only for so long as the conditions set for the herein are complied with. The City may revoke the Permit following a public hearing for violation of the terms and/or conditions set forth in the Permit.
