<br />Heritage Maples <br />January 17, 2006 <br /> <br />Page 2 <br /> <br />Attachments <br /> <br />Staff report from January 10th Planning Commission meeting <br />Resolution No. 06-_ <br />Ordinance No. 06-_ <br /> <br />Overview <br /> <br />At their November 21 st meeting, the City Council postponed action on these items and <br />referred them back to the Planning Commission for further review. The plans presented to <br />the Council had been revised since the Commission had reviewed them. The revisions were <br />in response to concerns the Commission had raised. The Planning Commission reviewed <br />this project at their January 10th meeting. Attached is the staff report and attachments from <br />that meeting <br /> <br />Planning Commission Meeting <br /> <br />At the January 10th Planning Commission meeting, no one spoke at the public hearing. The <br />applicant reviewed his requests. Two Commissioners were not convinced that the property <br />should be changed from commercial to residential. They felt that long term the site should <br />remain commercial. Four of the Commissioners thought that townhouses would be an <br />appropriate use of the site. The applicant has tried to market the site as commercial without <br />success, and the townhouses would be compatible with the surrounding residential uses. The <br />Commission thought that the townhouse elevations should, at minimum, comply with the <br />R3 design standards. The applicant said they would comply. They reviewed pedestrian <br />circulation and felt the proposed sidewalks were adequate. They were concerned about the <br />encroachment into the 20 foot wetland buffer. However, they felt the applicant made an <br />effort to avoid the buffer. The Commission voted 4:2 to recommend approval of the land <br />use amendment, zone change, conditional use permit and preliminary plat. <br /> <br />Recommendation <br /> <br />The Planning Commission and staff recommend that the Council approve the applicant's <br />request for a Land Use Plan amendment from CC to UR based on the following findings: <br /> <br />1. The proposed amendment is appropriate for this site because the proposed land use <br />is compatible with the adjacent residential land uses. <br />2. The proposed amendment is appropriate for this site because it is accessed from <br />local streets that service residential neighborhoods. <br /> <br />The Planning Commission and staff recommend that the Council approve the applicant's <br />request rezoning from C3 to PUD based on the following findings: <br /> <br />1. The proposed PUD zoning is consistent with the proposed land use of Urban <br />Residential. <br />2.
