He stated <br />curbing and medians would not be feasible at this time. He stated he saw this as an <br />opportunity to limit access points on Railroad Drive due to traffic congestion in the area. He <br />sited other examples where Council has done this in the city and stated it would make a <br />redevelopment opportunity for Railroad Drive much easier in the future. <br /> <br />Councilmember Farber stated he doesn't want to discourage a new business. He doesn't <br />want to limit access and believes citizens will use common sense and take the entrance that <br />will be the easiest depending upon the traffic. He stated if the area is to be redeveloped, then <br />access issues can be solved then. <br /> <br />Councilmember Dietz stated if access is closed to this business, then it should be done to all <br />the businesses in a fair manner. <br /> <br />Mr. Maurer suggested if the Railroad Drive entrance is allowed that the 4th Street also be <br />maintained as an entrance so citizens have an opportunity to enter from both sides. <br /> <br />Mr. Beck stated if the city were to close Railroad Drive as part of a redevelopment project <br />and for safety concerns, then the access points could be closed and reoriented to 4th Street. <br />He suggested continuing both items so staff can develop conditions to the conditional use <br />permit. <br /> <br />The applicant was acceptable to extending the timeframe to January 17, 2006. <br /> <br />MOVED BY COUNCILMEMBER FARBER AND SECONDED BY <br />COUNCILMEMBER GUMPHREY TO CONTINUE VARIANCE, CASE NO. 05- <br />05 AND CONDITIONAL USE PERMIT, CASE NO. CU 05-28 TO JANUARY 17, <br />2006. MOTION CARRIED 5-0. <br /> <br />7.5. Request by Bauerly Bros.. Inc. for Amendment to Conditional Use Permit. Public Hearing- <br />Case No. CU 05-21 <br /> <br />Ms. Haug stated the applicant is requesting a conditional use permit to mine 13-21 feet into <br />a water table on the Toth property. She stated the Technical Evaluation Panel has <br />determined that this project would be exempt from compliance of wetland issues. She stated <br />this site was included in the city's Environmental Impact Statement for Mineral Excavation <br />in 1994. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />John Henry, representing the applicant-Explained testing done at the site. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER GUMPHREY TO APPROVE CONDITIONAL USE <br />PERMIT, CASE NO. CU 05-21 WITH THE AGREEMENT INCLUDED IN THE <br />STAFF REPORT. MOTION CARRIED 5-0. <br /> <br />The Council took a ten minute break. <br />
