WHEREAS, on Dec 18, 2023, the Elk River City Council adopted Ordinance 23-27 amending Sec- tions 30-1850 through Sections 30-1855, of the Elk River Code of Ordinances; and WHEREAS, this Wetland Ordi- nance is expanded to protect wet- lands to the maximum extent pos- sible while allowing a reasonable use of the property; and WHEREAS, this ordinance adopts the regulations and stan- dards of the Wetland Conservation Act of 1991 (WCA), Laws of Minne- sota 1991, chapter 354, as amend- ed, and the rules adopted pursuant to the WCA; and WHEREAS, this ordinance pro- vides additional information and detail on the permitted uses al- lowed to assist residents in their planning and development pro- cess, and WHEREAS, this ordinance pro- vides additional information to residents on the Standards for Wet- lands. Buffer Areas, and Neighbor- ing Lands, and WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the office of the Elk River City Clerk, 13065 Orono Parkway, during reg- ular business hours; and NOW, THEREFORE, BE IT RE- SOLVED by the City Council, by at least four -fifths vote, authorizes the publication of the title and summa- ry of Ordinance 23-27. The motion for adoption of the foregoing resolution was duly sec- onded by Councilmember Gruoa, and upon vote being taken thereon, the following voted in favor thereof Mayor John Dietz, Councllmem- bers Cory Gruoa.
