City of Elk -�-� RiVer City of Elk River City Council Resolution 23- A Resolution of the City Council of the City of Elk River Approving the Renaming of the Plat of The Cove to The Cove on Lake Orono WHEREAS, on June 23, 2023, Zach Brown with BK Land Development ("Applicant") having previouslyT received final plat approval for a plat of the same name, submitted an application for Final Plat approval of The Cove; and WHEREAS, on August 7, 2023, the Cit�r Council adopted resolution 23-28 approving the plat of The Cove; and WHEREAS, the approval `vas based on all standards required for the review and approval of a final plat in accordance `vith Sec. 30-374; and WHEREAS, afteY having verified all conditions of approval Yequired of resolution 23-28 and signing the mylars, released the signed plat to the Applicant for recording with Sherburne CountyT; and WHEREAS, upon recording the plat of The Cove `vith Sherburne Count�T, staff was contacted b�T the count�T stating that a plat of the same name had previousl�T been recorded and that the cuYrent plat must be Yenamed; and WHEREAS, the Applicant has provided a ne�v final plat document changing the plat name to The Cove on Lake Orono. NOW, THEREFORE, BE IT RESOLVED 1. Final plat approval was previously granted for the Property and the current action provides no alteration to the previously approved plat other than the name. 2. i� The officeYs of the Cityr aYe heYebyr authorized to sign the final plat foY the PYopeYt�r and to issue a certified copyT of this Resolution giving final approval of the plat as renamed. The o`vner of the property is authorized to record the final plat as required b�T la�u and shall file proof of said recording with the CityT. No building permits `vill be issued for the propertyr until the final plat is recoYded.
