The same property owner indicated they maintain the access drive and questioned who was responsible for
maintaining the shared drive now. The access drive, not built to city standards, is in the right-of-way dedicated
with the Houles Second Addition plat. Currently the city does not maintain the access drive and staff could not
locate anything stating the maintenance would be required by the property owner.

The applicant informed staff that they will work with the adjacent property owner to the west on an agreement of
the maintenance responsibilities of the shared access. The adjacent property owner is out of town currently.
Additional alternatives include vacating the right-of-way, which would add the property to the adjacent
landowner’s parcel, keeping his access and use on one parcel. This would also require the subject property to move
their access to the east. Lastly, the right-of-way could be vacated, and the owners can generate their own
agreement to continue utilizing the existing driveway without the city’s involvement.

The Planning Commission had no questions or concerns about the request and unanimously recommended
approval. Staff have not received any comments since the commission meeting.

Since the meeting, the outdoor storage area/fencing and landscaping have been identified as shown on the
attached site plans.

Financial Impact
None

Mission/Policy/Goal
 Responsibly grow
 Work with citizens to achieve goals

Attachments
 Updated Site Plans
 Landscape Plan
 Right-of-way Options
 Planning Commission Memo dated September 26, 2023
 Material Brochure
