City Council Minutes <br />September 18, 2023 <br />Page 4 <br />considered for businesses would influence current businesses such as shutting down and not being <br />able to operate. <br />Mayor Dietz closed the public hearing. <br />Mayor Dietz asked the Counselor Schmidt if those who apply for an IUP now, or already have an <br />existing business in an accessory building, would be grandfathered. Counselor Schmidt answered and <br />stated yes if they qualify for what the code currently requires for an IUP, but they would not be <br />allowed to expand. <br />Mr. Leeseberg clarified that according to current ordinance, home occupations cannot apply for an <br />IUP. He stated staff needs clarification from the Council regarding what should be placed in the <br />ordinance regarding outdoor storage and accessory structures. <br />The Council discussed and agreed that this is a difficult topic and there are different situations with <br />each business and a general ordinance does not fit all businesses. They agreed an occupation in an <br />accessorystructure should be allowed and agreed with the Planning Commission that there would not <br />be outdoor storage allowed. After discussing they decided to move forward with allowing IUPs. There <br />was discussion regarding setback requirements and the consensus was to keep the current tiered <br />setback standards. <br />Mayor Dietz stated if we go with the IUP process then we need to really publicize that they will need <br />an architect up front before moving forward. <br />8.1 Set Budget Meeting Date and Adopt Preliminary 2024 Tax Levy <br />Mr. Stremcha presented the staff report. <br />Moved by Councilmember Wagner and seconded by Councilmember Beyer to set the budget <br />meeting for public comment to be on Monday, December 4, 2023, at 6:30 p.m. Motion carried <br />5-0. <br />Moved by Councilmember Westgaard and seconded by Councilmember Grupa to adopt <br />Resolution 23-39 authorizing the preliminary property tax levy for collection in 2024. Motion <br />carried 5-0. <br />8.2 EDA and HRA 2024 Budget and Tax Levy <br />Mr. O'Neil presented the staff report. <br />Moved by Councilmember Westgaard and seconded by Councilmember Grupa to adopt <br />Resolution 23-37 establishing the EDA tax levy of $415,950 for collection in the year 2024. <br />Motion carried 5-0. <br />Moved by Councilmember Beyer and seconded by Councilmember Wagner to adopt <br />Resolution 23-38 establishing the HRA tax levy of $440,100 for collection in the year 2024. <br />Motion carried 5-0. <br />P 0 0 E A I 8 9 <br />NATURE <br />
