<br />c ( V\<A,",~ o~* <br />y)\ \q \ oS- <br />INFORMATION <br /> <br /> <br />MEMORANDUM <br /> <br />SUBJECT: Park Deditation for Bluff Block and Jackson Place <br /> <br />The purpose of this memorandum is to inform Council regarding a recent discussion by <br />Metro Plains concerning the actual amount of park dedication that is due for the Bluff Block <br />and Jackson Place projects. It has been Metro Plains' contention that the applicable rates are <br />the City's 2004 park dedication fees, not 2005. In examining the main narrative language of <br />the Developer's Agreement it is clear that the SAC and WAC fees are both waived and <br />calculated with 2004 rates, but it appears silent on the issue of park dedication fees. <br /> <br />Staff has investigated this issue and has found a memo that discusses an agreement between <br />staff and the developer that the 2004 rates will be used. In addition, the specific rates were <br />. then used in Exhibit "D", "Sources and Uses Statement." Based on this and other general <br />discussions with individuals involved in the original negotiations, staff has concluded that <br />both the intent and the Agreement itself dictates that the developer needs to pay the 2004 <br />rates. This issue was discussed and also agreed to by the Parks and Recreation Director.
