<br /> <br /> <br />City of Elk River <br /> <br />City Council <br /> <br />Resolution 23-____ <br /> <br />A Resolution of the City Council of the City of Elk River to Submit <br />Information to the Minnesota Public Facilities Authority (MPFA) and Enter <br />Into a Grant Agreement with the MPFA. <br /> <br />WHEREAS, under the provisions contained in Laws of Minnesota 2023 chapter 72, article <br />1, section 23, subd. 13, $1,100,000 was appropriated to the MPFA <br /> <br />“For a grant to the city of Elk River to decommission a failed subsurface sewage treatment <br />system in the northeast part of the city, remediate associated contaminated soil, and acquire <br />easements, design, and construct a lift station that will connect the existing low-pressure <br />sanitary force main in the northeast part of the city to the city's existing sewer system.” <br /> <br />WHEREAS, to receive this money, the City of Elk River must submit required <br />information and enter into a Grant Agreement with the MPFA; and <br /> <br />WHEREAS, that the City of Elk River has the legal authority to apply for the grant, and <br />the financial, technical, and managerial capacity to ensure proper construction, operation and <br />maintenance of the project for its design life. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, as follows: agrees with the provisions of the MPFA grant and will <br />construct this sanitary sewer extension to connect 28 single family homes with the Rolling <br />Hills Subdivision to the city’s existing sanitary sewer system. <br /> <br />BE IT FURTHER RESOLVED that the Grant Agreement shall be executed on behalf of <br />the City of Elk River by the signature of its Mayor and its City Clerk. In the event of <br />disability or resignation or other absence of either such officer, the Grant Agreement may be <br />signed by the manual signature of that officer who may act on behalf of such absent or <br />disabled officer. In case either such officer whose signature shall appear on the Grant <br />Agreement shall cease to be such officer before delivery of the Grant Agreement, such <br />signature shall nevertheless be valid and sufficient for all purposes, the same as if he or she <br />had remained in office until delivery. <br /> <br />Passed and adopted this 5th day of September 2023. <br /> <br /> <br /> <br /> John J.
