ireserved !or recordin�l <br />PERMANENT EASEMENT AGREEMENT <br />This PERMANENT EASEMENT AGREEMENT (`Basement") is made by and between <br />ROLLING HILLS HOMEOWNERS ASSOCIATION, a Minnesota nonprofit corporation <br />("Grantor"), and the CITY OF ELK RIVER, a Minnesota municipal corporation ("City"). <br />Grantor, in consideration of $1.00 and other good and valuable consideration, the receipt <br />and sufficiency of which is hereby acknowledged, does hereby grant unto the City, its successors <br />and assigns, the following easement: <br />1. Permanent Easement. A permanent, non-exclusive easement for public drainage <br />and utility purposes over, across, on, under and through the land situated within the County of <br />Sherburne, State of Minnesota (the "Easement Premises") that is legally described as follows: <br />Outlot B, ROLLING HILLS, according to the recorded plat thereof, Sherburne <br />County, Minnesota. <br />Such permanent easement is legally described on Exhibit A and depicted on Exhibit B, and <br />includes the rights of the City, its contractors, agents, servants and assigns to enter upon the <br />Easement Premises at all reasonable times to construct, reconstruct, inspect, repair, and maintain <br />the drainage and utility systems over, across, on, under and through the Easement Premises, <br />together with the right to grade, level, fill, drain, pave, and excavate the Easement Premises, and <br />1 <br />226712v2 <br />
