Conditional Use Permit/PUD <br />The issuance of a Conditional Use Permit can be ordered oril�T if the use at the proposed location: <br />LVill not en�ngeT; injuze o�• detTz7nentally a�ect the use and enjoylnent of othe�•p�opeT�y in the i�nlnediate viciniiy oz• the <br />pul�lic bealth, safety, 1no�als, colnfo��, convenience o7•gene�al za�elfa�e of the neighl�o�hood oz• the city. <br />The current project is similar in layout and design as the residential developments to the north and <br />west of the pYoject area. The pYoject aYea is bordeYed on the east byr County Road 40, with large lot <br />Yesidential across the street. Finally, the south side of the project abuts a large wetland complex with <br />the Spectrum athletic complex beyrond that. <br />The subdivision will not endanger or detrimentallyT affect the use and enjo�Tment of other properries in <br />the immediate vicinityT as the project continues a similar development pattern as what has been <br />established for this area. <br />2. LVill l�e consistent �arith tbe Co�npzehensive Plan. <br />The propert�T is guided for mixed-residential use where residential uses are permitted. The proposed <br />use is consistent with the compYehensive plan. <br />3. LVill not ilnpede the no��nal and oy�e�•ly developinent and ilnpTovelnent of suzrounding vacantpTope��y. <br />TheYe are two developable paYcels that abut the pYoject area. The developer has provided ghost plats <br />demonstraring how the paYcels can be developed and adequate connections, both street and utilityr, to <br />those parcels are provided with this subdivision. <br />4. LVill l�e seTved adeguately ly and �a�ill not adveT:sely affect essential pul�lic facilities and seTvices including streets, police and <br />fiy�e pTotection, dTainage, refuse dis�osal, �a�atey and seaa�er� syste�ns, paTks and schools; and �a�ill not, in paT7icz�lay, c7eate <br />tTa�c congestion o�� inte�, fe��ence aanth t�a�c on adjacent and neighl�orzngpul�lic thoroughfaTes. <br />As part of the pre-development revie`v the applicant completed a mandatoryT environmental revie�v <br />(EA� `vhich did not identif�T an�T significant impacts to essential public facilities. The EAW included <br />a traffic analyTsis and while traffic on the surrounding net�vork `vill increase as a result of this project, <br />the existing network is not adversely affected. The improvements completed by Sherburne Count�T <br />along CSAH 12 and Twin Lakes Road have improved safetyT and mobilinT to support the gro`vth in the <br />area. <br />TheYe is a new fire station one-half mile north of the development and all sewer and water <br />infrastructure will meet cityr standards subject to the proposed conditions. <br />The project also includes a 5.5 acre park that will be dedicated to the cityr for future park needs in the <br />area and the trails outlined above along with the additional trails recommended in the conditions of <br />approval will create a robust addition to the cityT's park and trail system. <br />5. LVill not involve uses, activities, processes, lnate�zal�; equ pinent., and conditions of ope�ation that �a�ill l�e det�zlnental to <br />any pe�sons o��prope��y l�ecause of excessive tra�c, noise, slnoke, fu�ne�; glare, odo��; dust oz� vil��ations. <br />The traffic and parking analyTsis sho`v that the project will not push public infrastructure beyTond <br />design capacities. Construction of the project will create noise, dust, and vibrations, but nothing that <br />should be considered detrimental to an�r persons or propert�r. <br />
