Workplace where prohibited items may be concealed. Employees should have no <br />expectation of privacy while in the Workplace, except in restrooms, locker rooms, or <br />dressing areas. <br />Drug Testing <br />Applicants and Utilities employees are subject to certain kinds of drug testing in <br />accordance with applicable law and Utilities policy. Separate policies are maintained for <br />CDL drivers and for other employees and are distributed at the start of employment and <br />periodically throughout employment. Copies of the Utilities' drug testing policies are <br />available upon request from Human Resources and the Administrations Director. <br />14. EXPOSURE TO HAZARDOUS SUBSTANCES <br />Any employee routinely exposed to hazardous substances or harmful physical agents as <br />defined in the Minnesota Employee Right to Know Act (MINN. STAT. § 182.675) shall be <br />trained before being assigned or reassigned work exposing the employee to such substances <br />or agents and shall be given training annually thereafter. Training shall include an <br />explanation of how and where information about hazards is stored in the workplace, how <br />the hazards are labeled, and where to obtain specific information. The supervisor (or other <br />designee) shall provide for such training and for compliance with the Minnesota Employee <br />Right to Know Act, including the establishment of specific policies to insure compliance <br />with the state law and regulations. An employee acting in good faith has the right to refuse <br />to work under conditions which the employee reasonably believes present an imminent <br />danger of death or serious physical harm to the employee. <br />15. SOLICITATION AND DISTRIBUTION <br />The Utilities intends to establish and maintain a safe and productive business environment <br />and to prevent interference with the work of its employees. This policy prohibits <br />solicitation and the distribution of literature on Utilities property by non -employees. In <br />addition, this policy addresses the limited circumstances under which solicitation and the <br />distribution of literature on Utilities property by employees will be permitted, and it <br />addresses the wearing and display of items, posting material on Utilities bulletin boards, <br />and certain uses of the Utilities' computer, email, and other resources. <br />The term solicitation means any oral or electronic communication that encourages, <br />advocates, demands, or requests any position or action or contribution of money, time, <br />effort, personal involvement or membership in any organization or the sale or purchase of <br />any merchandise or service. <br />The term distribution means posting, handing out, or otherwise distributing any written <br />material in hard copy. <br />14 <br />June 2023 <br />61847929v4 <br />W <br />
