<br /> <br />Request for Action <br /> <br /> <br /> <br /> <br /> <br />To Item Number <br />Mayor and City Council 7.1 <br />Agenda Section Meeting Date Prepared by <br />Public Hearings June 5, 2023 Zack Carlton, Community Development Director <br />Item Description Reviewed by <br />Ordinance Amendment: Nuisance Ordinance Cal Portner, City Administrator <br />Reviewed by <br />Jared Shepherd, City Attorney <br /> <br />Action Requested <br />Adopt, by motion, an ordinance repealing and replacing the City of Elk River nuisance ordinance. <br /> <br />Adopt, by motion, a resolution approving summary publication of the nuisance ordinance update. <br /> <br />Background/Discussion <br />City staff, in consultation with the city attorney, have been working on a rewrite to the city’s nuisance ordinance – <br />Chapter 46, Article II. Our goal is to improve readability, clarity, add necessary updates, and outline enforcement <br />proceedings. <br /> <br />The Council reviewed a draft of this ordinance on February 9, 2023, and staff incorporated comments from that <br />meeting. Some of those changes include maintenance of non-developed lots, trash can placement, and <br />enforcement procedures for long grass and sidewalk snow removal. <br /> <br />One notable change, during the Rinker Conditional Use Permit public hearing, there was a lot of conversation <br />regarding applying the construction hours of operation to approved uses in the city. The previously reviewed <br />ordinance would have expanded the standard to apply to Rinker and their industrial operation, but during the <br />review of that project it was determined that the standard should not be applied to legal industrial operations.
