That § 38-35 (d)(3), Conduct of hearing of the City of Elk River Code of Ordinances shall be amended to read as follows: If a hearing is requested, written notice of the date and time of such hearing shall be sent to the licens- ee at least ten days prior thereto. Hearings shall be before the coun- cil, at which time evidence of any alleged violation or grounds upon which the proposed suspension or revocation would be based shall be presented to the council. The licensee may be represented by counsel and shall be given an op- portunity to be heard. SECTION 2. That § 38435 (e)(2), Summary action o1 the City of Elk River Cade of Ordinances shall be amended to read as follows: If a hearing Is requested as pro- vided in this subsection, written notice of the date and time of the hearing shall be sent to the licensee at least ten days prior thereto. The hearing shall be conducted in the same manner as if the aggrieved person had not been subject to summary action. SECTION 3.
