2. Findings of Fact <br />2.1 Project Description <br />Lennar Corporation is proposing construction of a residential development located at in the City of <br />Elk River, Sherburne County, Minnesota. The project will include the construction of approximately <br />433 single-family homes and 180 multi -family housing units as well as infrastructure such as roads, <br />utilities, walks/trails, and stormwater ponds. <br />2.2 Corrections to the EAW or Changes to the Project since the EAW was <br />Published. <br />There have been no changes or updates to the RAW since publication on December 13, 2023. The <br />summary of impacts and mitigation outlined below reflect the current proposed design. <br />2.3 Agency and Public Comments on the EAW <br />The City of Elk River received written comments during the comment period from the following <br />four agencies: <br />■ Minnesota Department of Transportation <br />■ Minnesota Department of Natural Resources <br />■ Minnesota State Historic Preservation Office <br />■ Army Corps of Engineers <br />Consistent with state environmental review rules, responses have been prepared for all substantive <br />comments submitted during the comment period. Written responses have been provided for <br />substantive comments pertaining to analysis conducted for and documented in the EAW (see <br />Appendix A). Original comments in their entirety are included in Appendix B. <br />2.4 Decision Regarding Need for an Environmental Impact Statement <br />The City of Elk River finds that the analysis completed for the EAW and the additional information <br />considered in this Findings of Fact and Conclusions document are adequate to determine whether <br />the project has the potential for significant environmental effects based on consideration of the four <br />criteria identified in Minnesota Rules, Part 4410.1700, Subd. 7 (described in the sections that follow). <br />2.4.1 Type, Extent, and Reversibility of impacts <br />The City of Elk River finds the analysis completed for the EAW is adequate to determine whether <br />the project has the potential for significant environmental effects. The RAW described the type and <br />extent of impacts to the natural and built environment anticipated to result from the proposed <br />project. The proposed design for the project includes features to mitigate the identified impacts. <br />Based on the RAW analysis and mitigation commitments, the proposed project is not anticipated to <br />result in substantial impacts. <br />Below is a summary of the findings regarding potential environmental impacts of the proposed <br />project and the design features included to avoid, minimize, and mitigate those impacts. <br />
