I. Administrative Background <br />Lennar Corporation is proposing construction of a residential development located at in the CityT of <br />Elk River, Sherburne Count�r, Minnesota. The project will include the construction of appro�matel�r <br />433 single-familyT homes and 180 multi-family housing units as well as infrastructure such as roads, <br />utilities, `valks/trails, and storm`vater ponds. <br />The CityT of Elk River is the Responsible Governmental Unit (RGU) for this project. An <br />Environmental Assessment Worksheet (EA� has been prepared in accordance `vith the iVlinnesota <br />Rules Chapter 4410. The EAW was mandator�r peY Minnesota Rules, Part 4410.4300, Subd. 19 D. <br />The EAW was filed with the Minnesota Environmental QualityT Board (EQB) and circulated for <br />review and comment to the required EAW distribution list. A notice of availabilityT was published in <br />the E�B Monito�� on December 13, 2022. A notice was also published in the StaY News. The notice <br />included a description of the project, information on `vhere copies of the EAW `vere available, and <br />invited the public to provide comments. <br />The EAW was made available electronically on the City of Elk River's website at <br />htt�s://����.elkrivermn.g�o�r/DocumentCenter/View/11562/Foster-Pro�ert��-EA�X� and in hard <br />copy at Elk RiveY City= Hall, 13065 Orono Parkway NW, Elk River, MN 55376. <br />The EAW comment period extended fYom DecembeY 13, 2022, to Januar�r 12, 2023. Written <br />comments `vere received from four agencies during the comment period. All comments received <br />were considered in determining the potential for significant environmental impacts. Comments and <br />responses to comments are included in Appendix A. <br />Based on the information in the record, �vhich is composed of the EAW for the proposed project, <br />the comments submitted during the public comment period, the responses to the comments, and <br />other supporting documents, the CinT of Elk River makes the follo`ving Findings of Fact and <br />Conclusions. <br />
