<br />Heritage Maples <br />November 21, 2005 <br /> <br />Page 2 <br /> <br />Attachments <br /> <br />Location Map <br />Staff packet from October 17th City Council meeting <br />Minutes from the October 17th City Council meeting <br />Resolution No. OS-_ <br />Ordinance No. 05-_ <br /> <br />Overview <br /> <br />At the October 17th City Council meeting this project was continued to allow the full <br />Council the opportunity to consider these items. The applicant has not submitted any <br />additional information or revised plans since that meeting. <br /> <br />The first and probably the most important request the Council will consider is the proposed <br />Land Use Plan amendment. The applicant is proposing to change the land use from <br />Community Commercial to Urban Residential. The other three requests, the zone change to <br />PUD, the conditional use permit for the PUD, and the preliminary plat can not be approved <br />unless the land use amendment is approved. <br /> <br />Attached are the minutes, staff report and information packet from the October 17th City <br />Council meeting. <br /> <br />Recommendation <br /> <br />Staff recommends that the Council approve the applicant's request for a Land Use Plan <br />amendment from CC to UR based on the following findings: <br /> <br />1. THE PROPOSED AMENDMENT IS APPROPRIATE FOR THIS SITE BECAUSE THE PROPOSED <br />LAND USE IS COMPATIBLE WITH THE ADJACENT RESIDENTIAL LAND USES. <br />2. THE PROPOSED AMENDMENT IS APPROPRIATE FOR THIS SITE BECAUSE IT IS ACCESSED <br />FROM LOCAL STREETS THAT SERVICE RESIDENTIAL NEIGHBORHOODS. <br /> <br />Staff recommends that the Council approve the applicant's request rezoning from C3 and <br />R3 to PUD based on the following findings: <br /> <br />1. THE PROPOSED PUD ZONING IS CONSISTENT WITH THE PROPOSED LAND USE OF <br />URBAN RESIDENTIAL. <br />2. THE PROPOSED PUD ZONING IS COMPATIBLE WITH THE ADJACENT SINGLE FAMILY <br />RESIDENTIAL AND TOWNHOUSE ZONING. <br /> <br />Staff recommends that the Council approve the conditional use permit for the PUD with the <br />following conditions: <br /> <br />1.
