<br /> <br />Item 7.3. <br /> <br />MEMORANDUM <br /> <br />TO: Mayor and City Council <br /> <br />FROM: Rebecca Haug, Environmental Administrator <br /> <br />DATE: November 21, 2005 <br /> <br />SUBJECT: Custom Motors Site Assessment (13913 Highway 10) <br /> <br />The former Custom Motor site, located at 13913 Highway 10 in Elk River, was also the <br />site of the RC Roll-off incident. The City of Elk River incurred $91,724.38 of expenses <br />for cleanup from that incident (see attached invoice). The City could still potentially <br />assess these expenses against this property. Landfill abatement funds were used for the <br />RC Roll-off cleanup. <br /> <br />The Minnesota Pollution Control Agency has deemed the property clear of contamination <br />from the RC Roll-Off incident, but there is still contamination on it from when it was <br />used as an automobile salvage yard (Custom Motors). A Phase II Environmental <br />Assessment of the property is needed and any contaminates found will need to be <br />removed prior to the property being redeveloped. The testing and clean-up, due to the <br />Custom Motors operation could potentially be quite expensive. <br /> <br />To encourage the former owner of the site, American Park Investment, to deal with any <br />contamination from the auto salvage operation in a timely manner, the City was willing <br />to cut in half the amount assessed against the property for the RC Roll-off cleanup. The <br />property has since changed hands and the Christian Alliance Church now owns it. <br /> <br />To get this property productive again and to put the RC Roll-Off incident behind us, staff <br />recommends the city aid the Church with their redevelopment plans by forgiving the <br />entire $91,724.38 RC Roll-Offpotential assessment. <br />
