During the cornpliance check at your <br />establishment, an employee sold a tobacco product to a person under the age of 21 <br />years. <br />This is in violarion of Minnesota Statute 461.12, Subd. 2-"Admuustrative penalty for sales <br />and fuinishing; licensees" and Elk River City Code. Pursuant to Minnesota Statute, an <br />administYative penalty is assessed to the licensee. This adininistrative penalty is $300 for a <br />first offense withui 36 months of selling tobacco to a person undeY the age of 21 yeaxs. Also, <br />according to City Code, you axe allowed the opportunity of a hearing before the City <br />Council. <br />Indicate on the enclosed form your request of a hearing before the City Council, ox if you <br />decide to waive the hearing, indicate that you aYe submitting payment of the admitustrarive <br />penalty.
