Title: Elk River Municipal Building Masonry Repair Proposal #: 23-107 <br />Work Site Location: Elk River. MN <br />All work to be completed in a workmanlike manner according to standard practices. Any alterations or deviation from above <br />specifications involving extra costs will be executed only upon written orders, and will become an extra charge over and above the <br />estimate. <br />All agreements contingent upon strikes, accidents or delays beyond our control. <br />Owner to carry fire, tornado and other necessary insurance. Our workers are fully covered by Workman's Compensation Insurance. <br />Owner agrees to supply Legacy Services Corporation with 110-volt power and water to complete the cleaning process. <br />PRE-LIEN NOTICE <br />WE ARE REQUIRED BY LAW TO PROVIDE YOU WITH THE FOLLOWING NOTICE: <br />A. ANY PERSON OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS <br />IMPROVEMENT TO YOUR PROPERTY MAY FILE A LIEN AGAINST YOUR <br />PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR SAID <br />CONTRIBUTIONS. B. UNDER MINNESOTA LAW, YOU HAVE THE RIGHT TO PAY <br />PERSONS WHO SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT <br />DIRECTLY AND DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE, OR <br />WITHHOLD THE AMOUNTS DUE THEM FROM US UNTIL 120 DAYS AFTER <br />COMPLETION OF THE IMPROVEMENT UNLESS WE GIVE YOU A LIEN WAIVER <br />SIGNED BY PERSONS WHO SUPPLIED ANY LABOR OR MATERIAL FOR THE <br />IMPROVEMENT AND WHO GAVE YOU TIMELY NOTICE. <br />Warrantv for Mold Abatement <br />Legacy Services Corporation represents and warrants that the services to be performed by Legacy shall be substantially in <br />accordance with mold abatement industry standards. Legacy makes no warranties or representation regarding, nor accepts any <br />responsibility, for fungi, contaminated dust, debris or other unwanted materials or substances that may grow, amplify or re-grow <br />subsequent to the perFormances of Legacy's services. Legacy expressly states that its services hereunder shall not be in any <br />manner deemed to prevent the future collection, distribution, growth, or amplification of microbial contamination and Legacy <br />expressly disclaims any responsibility or liability arising out of any microbial contamination that may grow or amplify subsequent to <br />the performance of Legacy's services. Legacy further disclaims any liability or responsibility for any indoor air pollution, which may <br />exist at the time of the performance of Legacy's services hereunder or which may subsequently exist as a result of the future <br />collection, distribution, growth, or amplification of microbial contamination in the specified work area. The foregoing warranty is the <br />sole and exclusive warranty provided by Legacy, and is in lieu of any and all other warranties, including, but not limited to any <br />warranty of inerchantability or fitness for a particular purpose. <br />Leqacv Services Warrantv <br />Pursuant to Minnesota Statute 327A.01 to 327A.08, Legacy provides the following residential warranties: 1) A one (1) year warranty <br />that its work will be free from defects caused by faulty workmanship and defective materials due to noncompliance with building <br />standards; 2) a two (2) year warranty that any plumbing, electrical, and heating and cooling systems will be free from defects caused <br />by faulty installation or noncompliance with building standards; and 3) a ten (10) year warranty that Legacy's work will be free from <br />major construction defects due to noncompliance with building standards. <br />Payment terms are Net 30. In the event payments are not made as outlined herein, the undersigned agrees to pay all costs of <br />collection and attorney's fees incurred by Legacy Services Corporation. <br />The above prices, specifications and conditions are hereby accepted.
