<br />. <br /> <br />. <br /> <br />. <br /> <br />City Council Minutes <br />October 17, 2005 <br /> <br />Page 4 <br /> <br />Councilmember Motin questioned if a condition should be added stating a joint access <br />agreement is needed. <br /> <br />Mr. Leeseberg stated this condition should be included. <br /> <br />Councilmember Motin questioned why the minimum lot size for the two parcels falls under <br />the minimum 10 acre requirement. <br /> <br />Mr. Leeseberg stated the Board of Adjustments granted a variance to the applicant. <br /> <br />Brad Stevens, Planning Commissioner-Stated the applicant met the ordinance requirements <br />for a variance. He stated there are wetlands on the property that would prevent it from <br />being subdivided into 2 !j2 acre lots when allowed in 2010. <br /> <br />Councilmember Farber stated the minimum lot size for this parcel is 10 acres and <br />questioned if a precedent would be set because these lots are being divided into less then 10 <br />acres. <br /> <br />City Attorney Peter Beck stated that in the past the city has granted administrative <br />subdivisions for plats that fall under the minimum due to the amount of property the <br />city/county takes for right of way. He further stated the city shouldn't take the future 2 % <br />acre zoning into consideration. He noted that this parcel was originally under 20 acres prior <br />to the right of way being taken. <br /> <br />MOVED BY COUNCILMEMBER FARBER AND SECONDED BY <br />COUNCILMEMBER DIETZ TO APPROVE AN ADMINISTRATIVE <br />SUBDIVISION FOR PHILLIP OSBERG WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />1. PARK DEDICATION FEES FOR ONE LOT SHALL BE PAID PRIOR <br />TO RELEASING THE SUBDIVISION FOR RECORDING. <br /> <br />2. SURFACE WATER MANAGEMENT FEES FOR ONE LOT SHALL BE <br />PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. <br /> <br />3. A JOINT ACCESS AGREEMENT IS REQUIRED. <br /> <br />MOTION CARRIED 4-0. <br /> <br />6.3. Request by L&M Development for Preliminary Plat (pinewood Estates 2nd Addition). Public <br />Hearing, Case No. P 05-13 <br /> <br />Staff report submitted by Senior Planner Scott Harlicker. Mr. Harlicker stated the Council <br />continued (from August 15) the preliminary plat for Pinewood Estates 2nd Addition to <br />tonight's meeting. He stated the applicant has revised the preliminary plat based on Council <br />comments at the last meeting. <br /> <br />Acting Mayor Dietz stated the Mayor could not be at the meeting tonight and he read a <br />letter that she wrote to residents regarding this plat. Acting Mayor Dietz stated the city has <br />begun the process of negotiating with owner Paul Krause to try and buy the golf course. He <br />further stated that there is no guarantee that the city will buy the course. <br />
