Board of Adjustments Minutes Page 2 <br />November 22, 2022 <br />----------------------------- <br />There being no one to speak, Vice Chair Beise continued the public hearing to <br />December 20, 2022. <br /> <br />5.2 Paul Peterson – Fresno St. NW <br /> Variance for a 10’ rear yard setback to construct a home, Case <br />No. V 22-15 <br /> <br />Mr. Leeseberg presented the staff report. <br /> <br />Commissioner Maurer asked about the applicant wishing for a front yard setback. <br /> <br />Mr. Leeseberg stated the applicant would prefer a larger rear yard. <br /> <br />Commissioner Maurer asked if the driveway location would be something to discuss <br />tonight or at a different time. <br /> <br />Mr. Leeseberg indicated the driveway location would be part of the building permit <br />process and would be reviewed by the city engineer. <br /> <br />Vice Chair Beise opened the public hearing. <br /> <br />Jim Hecker, 13196 Mississippi Road, indicated his property adjoins the applicant’s <br />and asked for clarification regarding the setbacks from the 2018 meeting. His notes <br />indicated the setback was 25’. He indicated he has no concerns with where the home <br />is proposed but asked if staff could foresee there being any impacts to his property. <br /> <br />Mr. Leeseberg indicated the information in the 2018 staff report was incorrect and <br />should have referenced a 15’ setback. Mr. Leeseberg stated a shed can be placed 5’ <br />from the property line. Staff doesn’t see any issues with future impacts. <br /> <br />th <br />Amy Banker, 13149 180 Avenue NW, expressed concerns about the location of <br />the proposed driveway, explaining the traffic and pedestrians on the road makes it a <br />precarious area already. <br /> <br />Mr. Leeseberg indicated the owner of the lot would work with the city engineer <br />during the building permit process to address the proper location of the driveway. <br /> <br />There being no one else to speak, Vice Chair Beise closed the public hearing. <br /> <br />Moved by Commissioner Johnson and seconded by Commissioner Keisling <br />to approve the request by Paul Peterson for a variance for a 10’ rear yard <br />setback to construct a home at 18094 Zane St. NW as all five of the criteria <br />required for approval of the variance are met as outlined in the staff report. <br /> <br />Motion carried 5-0. <br /> <br /> <br /> <br />
