Person means one or more natural persons; a partnership, including a limited partnership; <br />a corporation, including a foreign, domestic, or nonprofit corporation; a trust; a political <br />subdivision of the state; or any other business organization. <br />School means a building used for the purpose of elementary or secondary education, which <br />meets all the requirements of compulsory education laws of the State of Minnesota, and not <br />providing residential accommodations. <br />Self -Service Merchandising means a method of displaying Cannabinoid Products so that <br />they are accessible to the public without the intervention of an applicant, licensee or their agents <br />or employees. <br />THC means the chemical compound tetrahydrocannabinol whether derived naturally or <br />synthetically from the cannabis plant. <br />Underage Person means a person who is under the age of 21. <br />Vending Machine means any mechanical, electric, or electronic, self- service device which, <br />upon insertion of money, tokens, or any other form of payment, dispenses Cannabinoid Products <br />and including vending machines equipped with manual, electric or electronic locking devices. <br />DIVISION 2. - LICENSE <br />Sec. 26-112. - Required. <br />No person shall sell or offer to sell any Cannabinoid Products without first having obtained <br />a license to do so from the city. <br />Sec. 26-113. - Licensing Procedure. <br />(a) Application. An application for a license to sell Cannabinoid Products shall be made on a <br />form provided by the city. The application shall include, but is not limited to, requiring the <br />full name of the applicant, the applicant's residential and business address and telephone <br />numbers, the name of the proposed licensee, and the business location for which the license <br />is sought. The application and investigation fees shall be paid at the time of application. <br />All license applications under this division shall be made to the Office of the City Clerk <br />and referred to the chief of police and such other municipal departments or offices as the <br />city clerk deems necessary for verification and investigation of the facts set forth in the <br />application. The chief of police and other department directors or officers consulted shall <br />submit their reports and recommendations to the city administrator or designee. <br />If the city administrator or designee determines that an application is incomplete, he or she <br />shall return the application to the applicant with notice of the deficiencies. <br />223852v9 <br />
