Due to material costs and design changes, the interior roof structure needed to be increased in height to <br />accommodate new structural materials, pushing the height above 18 feet. <br /> <br />The height of the structures was of one of the main concerns during the original CUP review process. As part of <br />the CUP/PUD process, the council reviewed/approved site plans, landscape plans, and building designs to be <br />incorporated into the PUD agreement. When the building permit was turned in, staff informed the applicant that a <br />CUP amendment would be required to increase the height beyond the 18feet, per what was originally approved by <br />the City Council. <br /> <br />Applicable Regulations <br />In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the <br />development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in <br />Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any <br />potentially adverse effects upon adjacent properties, the neighborhood or the city. <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public <br />health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. <br />Mini-storage facilities create minimal traffic compared to commercial uses and other than traffic, there are <br />no ongoing activities on site. Increasing the height by three feet along with landscaping plans will not <br />affect this. The use will not endanger, injure or detrimentally affect the use and enjoyment of other <br />property in the immediate vicinity or the public health, safety, morals, comfort, convenience, or general <br />welfare of the neighborhood or the city. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />2. Will be consistent with the Comprehensive Plan. <br />With the council approved Land Use Amendment (LU 22-02), the use is consistent with the <br />Comprehensive Plan. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />3. Will not impede the normal and orderly development and improvement of surrounding vacant property. <br />While there are two vacant parcels in the area and the surrounding uses include, mixed residential, a train <br />station, and trucking terminals, the use will not impede the normal and orderly development and <br />improvement of surrounding vacant property. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />4.
