The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public <br />health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. <br />The subject parcel is in a commercial development with the façade of the proposed sign facing Evans <br />Street and Highway 169. A residential district is directly east of the subject parcel, but the proposed sign is <br />facing west. <br /> <br />If the property were zoned C3 Highway Commercial, the structure would be allowed to have wall sign <br />area up to 15 percent of façade area. With the proposed signage, there will be approximately 8 percent of <br />coverage on the building. As the use will not endanger, injure or detrimentally affect the use and <br />enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, <br />convenience, or general welfare of the neighborhood or the city, staff recommends the wall signage on the <br />west building façade not exceed 15 percent coverage. <br /> <br />2. Will be consistent with the comprehensive plan. <br />The property has a land use designation of Highway Business which allows for a wide variety of uses, <br />including signs accessory to approved uses. The use will be consistent with the Comprehensive Plan. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />3. Will not impede the normal and orderly development and improvement of surrounding vacant property. <br />There is one vacant commercial parcel south of the subject parcel which is also owned by Coborns, the <br />owner as the subject parcel. The use will not impede the normal and orderly development and <br />improvement of surrounding vacant property. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire <br />protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic <br />congestion or interference with traffic on adjacent and neighboring public thoroughfares. <br />The sign is setback approximately 250 feet from the drive lane of Evans Street which should not interfere <br />with the traffic. The sign will not create traffic congestion or interfere with traffic on adjacent and <br />neighboring public thoroughfares. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any <br />persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. <br />Signs are an expected use within a commercial development and if the property were zoned C-3, the <br />proposal would not exceed what is allowed. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. <br />The installation of a wall sign will not result in the destruction, loss or damage of a natural, scenic or <br />historic feature of major importance. <br /> <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br /> <br />
