2.7 Deed Notation <br />Sherburne County will record a notation on the deed to the property, or on some other instrument <br />normally examined during a title search. The notation will, in perpetuity, notify any potential purchasers of <br />the property of any special conditions or limitations for use of the site. The notation will include record <br />drawings for the facility. A copy of the notation carrying the County Recorder's seal will be included with <br />the final closure certification. <br />2.8 Amendment Of Closure Plan <br />A modified closure plan will be prepared and submitted to the MPCA for approval within 60 days of any <br />change or event that affects the Closure Plan. This applies to any change in the Operations and <br />Maintenance Plan or facility design affecting closure procedures, or whenever the expected year of <br />closure changes. In the case of this facility, the Closure Plan is reviewed on an annual basis during <br />preparation of the annual report and will be updated at the time of re -permitting to incorporate any <br />changes in operations, design or scheduling of closure. <br />2.9 Closure Cost Estimate <br />MPCA Rules Part 7035.2685 requires that a cost estimate be prepared for closure of the largest area that <br />may require closure. For purposes of financial assurance, it is assumed that 72 acres will require closure, <br />which provides for the largest, most expensive closure activity, as required by the MPCA Rules. Table 2 <br />presents the estimated closure costs and justification for the proposed closure. Prices reflect past project <br />experience and those typical of construction projects in the area. <br />Closure cost estimates will be updated by March 1 of each year to adjust for inflation, areas previously <br />closed, and changes in design, closure plans, or site conditions which require changes in the cost <br />estimates. <br />BProject Number: 227705133 2.3 <br />
