Request for Action <br />To <br />Item Number <br />Mayor and Ci T Council <br />8.1 <br />Agenda Section <br />Meeting Date <br />Prepared by <br />General Business <br />October 3, 2022 <br />Tim Dalton, FT Center Superintendent <br />Item Description <br />Reviewed by <br />Revised 2022-23 Season Contract with the <br />Peter Beck, City Attorney <br />Minnesota Squatch Junior Hockey Team <br />Reviewed by <br />Cal Portner, City Administrator <br />Action Requested <br />Approve, by motion, the Ice Purchase and Facility Use Contract with the Minnesota Squatch junior hockey team. <br />Background/Discussion <br />On May 2, 2022, City Council directed staff to develop a one-year contract for use of the Furniture and Things <br />Community Event Center with the Minnesota Squatch Tier III junior hockey team for the 2022-23 season. <br />The team needs a resident locker room as their players, who come from throughout North America and Europe, <br />pay to billet with families in the community and need a place to store their gear. Unlike the Elk River High School <br />teams, the team will manage all game functions, including ticket sales, admission, and spectator control. The <br />Multipurpose Facility Advisory Commission had reviewed and recommended approval of the original contract. <br />On September 19, 2022, the Council directed staff to revisit the contract and bring a revised contract back to the <br />Council for consideration tonight. The Council indicated five areas of the contract to be revisited. Ancillary use of <br />facility space; Damage clause; Caterer fee to City; Office/Locker Room Lease; Game Fee. <br />Those five areas have been addressed as follows: <br />1) Team will pay all regular facility use charges for rooms and space in the facility. <br />2) Damage Clause included to cover all areas of the building, requiring the renter to pay for any damages. <br />3) The catering vendor serving the junior team games will pay 6.5% of vendor's net revenue generated <br />through concession and food services and liquor sales, (beer and wine), sales to the City of Elk River. Net <br />revenues shall be defined as the vendor's gross sales less sales taxes, refunds, rebates, credits or returns. <br />This is the same language the previous caterer would have paid by contract. <br />4) Office/Locker room lease as originally negotiated. <br />5) Game fee as originally negotiated. The Minnesota Squatch request that the city honor the room lease and <br />game fee amount as they were negotiated in good faith and take into consideration that the team purchases <br />a large amount of previously unsold to weekday morning ice time. The Minnesota Squatch note this is the <br />team's initial season, and is a one-year agreement.
