PRO`TII�ER will notify the LTSER of any damages and allaw the USER a reasanable opportuniry to review the damage befUre repairs are made. PROVIDER is tespons�ble far the repair or repIacement of PROVIDER'S property and wi11 int�oice the LTSER for the darnages. USER'S obligation shall be to reunburse PRO`'IDER for the cost af labor and replacement of like-kind and quality equipment. 1'RC��'II�FR agrees to indemnif�= and hc�ld harniless LTSER from and against all claims, costs, expenses(uicluding attorney fees) and liabiIities of whatever nature a�ri�sing from(i) an�- negligent or wtongful act ar omissian of PRC7VIDER, its licei�sees, agents, or emplayees; or {u) arising from any accident, injur}�, including death, or damagc �a any person or propert�� occurring on the premises and caused by the ne�ligenee or other wrongful conduct of PRC)VIDER, excluding claims arising from L'S�R'S performance under this ag�eement This paragraph shall n�t act as a waiver of any tort liability caps ar legat immuniti�s that ma}- exist to protect the PROVIDER. L?SER agrees t� indemni€y and hold harmless PRO�TIDER from and against all claims, costs, expenses(including attorney fees) and liabilities of u-hatever nature arising from (i} any negligent or wrongful act of omission of L?SER, its licensees, agents, e�r employees; or (ii) arising fr�m anjr accident, injury, incauding death, or damage to any person or prc�per�� occurring on the prernises and caused by the negligence or ather wron�ful canduct c�f LTSER, e�cluding claims arising from PROtiTIDER's performance under this agreement. INSURANCE: Both LTSEA and PAOVIDEA shall maintain liability insu�ance against claims fox i�odily injwry, death or prope�ty damage c�ccurring on or abaut the FTCente�. Such insurance shall 6e u�-ritten on an �ccurrence basis u-ith a combined single lirrut of not less than �1,oaa,00(} per occuxrence. If the insurance policy is written on a"clasrns-made 6asis," the party ��°ill maintair� co��c:rage fc�r a mi�imum of three years past the expirarion of this agreernent. The retroacuz�e date of the policy shall be indicated on the certificate of insurance outlining coverage. In addition, both parties shall name the other part�� as an additional insured vvith respect to its own operarians on said policies of insurance_ Both parries wiIl maintain all workers ce�mp�nsation insurance �requ�ed by law. 5
