(04) Street Construction. No street construction will be allowed after October 15 or prior to <br />May 15 unless approved by the Cit�r Engineer. <br />(05) Snow�lowing. Until the Impro�=ements are accepted by the Cit�- or an agreement eYpressly <br />reached in advance, the developer is responsible for snow removal and ensuring access by Emergency <br />Response equipment. <br />(06) Mailboxes. All mailboxes be clustered, and in a style and location acceptable to the City of <br />Elk River. <br />(07) Hi.storv. Any item or condition found that indicates the site is likely to yield information <br />important to pre-history or history shall be reported to the cit�r immediately, and the cit�r reserves the <br />right in such event, to stop work immediately until the subdivision is appropriately investigated and <br />developer is authorized to recommence work. <br />11. Park Dedication. Developer shall satisfy park dedication requirements through a <br />combination of off-site trail construction and a cash donation equal to the low-densit�- Park Dedication <br />fee identified in the city's fee schedule at the time of Final Plat recording. <br />(01) The fee schedule requires a total cash donation of Sixty-One Thousand, Three Hundred <br />Fourteen and 99/100 dollars (61,314.99) for the entire preliminary plat Construction by developer of <br />the off-site trail improvement described in EXHIBIT F are estimated at Forty-Two Thousand, Eight <br />and 00/100 dollars ($42,008). <br />(02) Providing the Developer with a credit for construction of the off-site improvement will reduce <br />the overall park dedication obligation to $19,306.99 or Four-Hundred Forty-Nine and 00/100 (�449) <br />per lot. The current addition plats 28 lots, requiring a cash donation of Twelve Thousand, Five- <br />Hundred Se�Tent�--Two and 00/100 dollars ($12,572). <br />12. Develo�ment Plan. A de�Telopment plan "Development Plan" shall be submitted by <br />Developer and approved by the City Engineer or his designee prior to issuance of any builcling permit <br />within the Subdivision. The Development Plan will identify, for each lot in the Subdivision those items <br />noted on the checklist attached as Exhibit E to this Agreement. Approval of the Development Plan <br />may be contingent upon soil borings verifying elevations and compaction tests for proposed house pads. <br />13. Landsca�ing. Developer shall cause the homebuilder to install two over story (deciduous) <br />trees in the boulevard of each Lot. All required trees shall be 2 inches in caliper. <br />(01) All residential landscaping requirements shall be completed prior to occupancy of the dwelling <br />unit, or by June 1 following occupancy if occupancy occurs October 15 through May 31. <br />(02) In the event the landscaping, including trees and establishment of turf, is not complete at the <br />time of Certificate of Occupancy, the Cit�- may issue a certificate of occupancy and require the <br />provision of a cash deposit from the builder of the lot to guarantee the successful completion of the <br />landscaping improvement The cash deposit shall be no less than �1,000.00. The City, its employees, <br />agents or contractors shall have the right to go upon the property to complete the landscaping without <br />permission of the owner of the property or lot, and shall not be liable for trespass. The City may also <br />require a deposit as part of the building permit fee to secure compliance with the landscaping <br />requirements. <br />
