All the dogs are ahvayTs kept in the home except to go to the bathroom or playTtime/walks. The propertyT has an in- <br />ground fence and there are not outdoor kennels on site. <br />Public Hearing <br />Staff received a phone call from a neighboring resident inquiring what a commercial kennel meant Staff explained <br />the public hearing notice had an error and the requested was for a private kennel to allow them to have four dogs <br />as pets with no commercial activities. <br />Applicable Regulations <br />In approving a Conditional Use Permit, the council mayT impose such specific conditions `vith regard to the <br />development or operation of the proposed use as it considers necessaryT to satisfyT the seven standards set forth in <br />Section 30-654 and the requirements contained in this article and to promote compatibilityT with and minirnize any <br />potentially adverse effects upon adjacent properties, the neighborhood or the city. <br />The issuance of a Conditional Use Permit can be ordered onlyT if the use at the proposed location: <br />1. LVill not en�ngeT; injuTe oT� det�zlnentally affect the use and enjoylnent of othe��p�ope�fy in tbe ilnlnediate vicznity or the pul�lic <br />healtb, safety, �noTal�; coynfoTfi, convenience oa�general �a�eZfaze of the neighl�oahood o�� tbe city. <br />Without conditions, the use might endangeY, injure or detrimentally affect the use and enjoyment of other <br />properttT in the immediate vicinit�T or the public health, safet�r, morals, comfort, convenience, or general <br />welfare of the neighborhood or the city. <br />AnyT residential propertyT in the cityT can have up to six animal units without needing to obtain a permit. <br />The applicant is asking foY two additional animal units to be located on the subject parcel. As all pYopertyr <br />owners in the cityT are allowed six animal units (inside or outside), the applicant/subject property should <br />also be allo�ued the same amount as others in the cit�r. To protect the geneYal �uelfaYe of neaYbyr residents, <br />staff recommends a condition stating no more than six animal units shall be allo�ved outdoors at one time. <br />For this reason, staff is not recommending a ph�Tsical fence as it `vould not be required for anyT other <br />residents �vith six animal units. The propertyT has an existing in-round fencing system. Additionall�T, no <br />dogs designated as dangerous or potentiall�T dangerous shall be allo`ved on site. <br />2. LVill be consistent �a�ith tbe comp� ebensive plan. <br />The request is consistent �uith the Comprehensive Plan, `vhich guides the propertyT for residential uses. <br />Staff does not see a need to impose specific conditions to satisfyT this standard. <br />3. LVill not i�npede the noT�7nal and o��eT�•ly develop�nent and ilnpTove7nent of suT7ounding vacantpTope��y. <br />As the surrounding area is already developed with single family homes, the use will not impede the normal <br />and orderlyT development and improvement of surrounding vacant propertyT. <br />Staff does not see a need to impose specific conditions to satisfyT this standard. <br />4. LVill l�e seTved adequately by and �a�ill not adve�sely affect essential pul�lic facilities and se�vices including stTeets, police and fire <br />protection, d�ainage, Tefuse dis�osal, �a�ater� and se�a�e��systelns, pa�ks and schools; and �a�ill not, in pa�7icula�; cr�eate tza�c <br />congestion oT� inteT, fe� ence 2��ith t�a�c on adjacent and neigbl�o�zng pul�lic thorougbfaT es. <br />The property is adequately served b�T these facilities and will not adversel�T affect essential public facilities <br />and services including streets, police and fire protection, drainage, refuse disposal, water and sewer <br />
