<br />Pinewood Estates Second Addition/P 05-13 <br />October 17, 2005 <br /> <br />Page 3 <br /> <br />Lot in the Southwest Comer of Plat <br /> <br />On the previous plan there was a lot in the southwest comer that was non-conforming. This <br />lot was reconfigured so that it has direct access from Street B. On the previous plan access <br />was proposed from CR 30 and the County was not going to allow a driveway on CR 30. <br /> <br />Streets <br /> <br />There have been some minor changes to the street layout. The right-of-way for Street B has <br />been extended to County Road 30. The right-of-way for Street A has been shifted to the <br />north. There is a 20 foot wide strip of land between the right-of-way for Street A and the <br />rear lot lines of the adjacent single lots in West Oaks. <br /> <br />Parks and Recreation <br /> <br />The Park and Recreation Commission recommended that a trail be provided from Street A <br />to the west boundary of the plat, that a trail be installed along CR 30 and a connection be <br />included to Street B, and that a trail or sidewalk be installed along Waco Street. Park <br />dedication credit would be given for the land needed to provide the internal trail connections <br />with the remainder of the requirement being met with cash. <br /> <br />Landscaping <br /> <br />Street trees are provided throughout the project. The subdivision ordinance requires 108 <br />trees for this project; the applicant is providing 98 trees. Additional trees are required <br /> <br />Recommendation <br /> <br />Preliminary Plat <br /> <br />The City Council should note that case files supports the position that in communities <br />outside the seven county metro area, it is not mandated that the land use plan be consistent <br />with the zoning and that the zoning designation has the force of law. <br /> <br />The Planning Commission and staff recommended approval of the plat presented to the <br />Council at the August 15th meeting with 21 conditions. This revised plat has not been <br />brought back to the Commission for their review. The Commission was unanimous in its <br />opinion regarding the preliminary plat. They felt that the lots abutting Pinewood should be <br />at least 20,000 square feet. <br /> <br />Staff recommends that the City Council approve the preliminary plat for Pinewoods Estates <br />2nd Addition with the following conditions: <br /> <br />1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL <br />PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />S:\pLANNING\Case Files\2005\P 05-13 Pinewood Estates 2nd\p05-13CClO-17.doc <br />
