<br /> <br />ARTICLE VII <br /> <br />DEVELOPER COVENANTS <br /> <br />Section 7.1 Insurance. The Developer will provide and maintain or cause to be <br />maintained at all times and, from time to time at the request of the City, furnish the City with <br />proof of payment of premiums on insurance of amounts and coverages normally held by <br />businesses engaged in activities similar to those of the Developer. <br /> <br />Section 7.2 Maintenance and Operation of the Development. The Developer will <br />at all times during the term of this Agreement operate and maintain the Development in a safe <br />and secure way and in compliance with this Agreement and all federal, State and local laws, <br />regulations, rulings and ordinances applicable thereto. Developer shall pay all of the reasonable <br />and necessary expenses of the operation and maintenance of the Development, including all <br />premiums for insurance insuring against loss or damage thereto and adequate insurance against <br />liability for injury to persons or property arising from the Development as required pursuant to <br />this Agreement. Developer shall not knowingly cause any person working in or attending the <br />Development for any purpose, or any owner of a housing unit, to be exposed to any hazardous or <br />unsafe condition; provided that Developer shall not be in default hereunder if it has required the <br />contractors employed by Developer to perform work on the Development to take such <br />precautions as may be available to protect the persons in and around the Development from <br />hazards arising from the work, and has further required each such contractor to obtain and <br />maintain liability insurance protecting against liability to persons for injury arising from the <br />work. The expenses of operation and maintenance of the Development shall be borne solely by <br />Developer. The foregoing provisions shall apply to the Developer for only so long as the <br />Developer or an Affiliate is the owner of the Development and only as to such portions of the <br />Development which the Developer or an Affiliate owns. <br /> <br />1824344vRED V2 to VI; 10/12/05 <br /> <br />41 <br />
