Remove-AII@

16038 Jarvis Street Northwest
Elk River, Minnesota 55330
763.421.7437 (phone & fax)

September 12, 2005

Planning Commission, City of Elk River
13065 Orono Parkway
Elk River, MN 55330

To Whom It May Concern:

The deadline for compliance with conditions of our Conditional Use Permit is September
,
15. While the majority of these conditions have been met (residential tenant has vacated,
Sherburne County and Elk River Waste Haulers Licenses have been issued, approved
surface has been installed on all storage areas, specifications regarding storage and disposal
of debris are being followed), we have been held up on the installation of the fence.

The specific positioning and length of fence on the eastern border will be determined by
placement and size of a new building. Over the past year we have been analyzing the costs,
benefits, and positioning of this building. One factor determining the building's size is
available capital. While we are in excellent standings with our bank, we are finalizing
negotiations on the acquisition of a local company. [This transaction will allow us to
expand our business, while at the same time provide revenue from established regular
customers. J It should be noted that this transaction will not change the way we do business,
or the way the Jarvis property is used. Purchasing this business will require substantial
capital and potentially limit the size of our building, thereby increasing the size of the fence.
Our banker has recommended that we come to him with the entire project (business
acquisition, construction of new building, and property improvements including fence).
The acquisition of the new business has taken longer than we had anticipated, but is
approaching the final contract stage. At that point we can go to the bank.

Weare requesting a nine month extension for completion of conditions of our Conditional
Use Permit, A six month extension would cause the deadline to fall during the time of year
when the ground is frozen - making installation of a fence nearly impossible.

~erely,

/Errill;t~

Vice President

Partnering with uFrom the Heart" Foundation #v giving ~eusable goods new life.
