ERX CUP Review <br />May 6, 2022 <br />Page 2 <br />2. ERX makes its own snow which has, on occasion, resulted in snow blowing over onto the highway. Statute <br />160.175 allows State to mitigate impacts caused by development. MnDOT reserves the right to ticket them <br />for snow removal created by ERX impacting the highway. It's a concern of the Minnesota State Patrol also. <br />The planning commission recommended removing that condition stating MnDOT can work with the ERX in the <br />future to solve access issues. Because of this recommendation, District 3 would offer that: <br />1. MnDOT concurs with your April 28, 2022 email regarding the previous Tuesday's Planning Commission <br />meeting recommendations that: "All ingress/egress functions related to the subject parcel/CUP shall occur <br />at Brook Road and all access points be removed on US 169 by August 2024, or at a future CUP, whichever <br />occurs first." We would add that the need exists for a longer -term vision for this portion of US 169 and for <br />developing a plan for future access and local street network to support the City's future growth and <br />development in this area. <br />2. We also concur that recommendations that move forward from the "169 Redefine project in 2024 will be <br />complete and the conversion of US Highway 169 to a freeway will greatly affect traffic patterns, primarily <br />overserved with a lack of openings in traffic and providing minimal opportunities to safely enter/cross US <br />169." <br />3. Any changes or modification or removal of any current entrances to the ERC would need to be coordinated <br />with District 3 and would need to be at no cost to the State. <br />4.
